TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of shoptiko.ca (the “Site”) and any purchase you make through it. The Site is operated by 2260221 Alberta Inc., operating as Shoptiko Eyecare (“Shoptiko,” “we,” “us” or “our”). By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. ELIGIBILITY

You must be at least the age of majority in your province or territory of residence, or have the consent of a parent or guardian, to use the Site or place an order.

2. ACCOUNTS

You may need to create an account to place certain orders or manage subscriptions. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@shoptiko.ca if you suspect unauthorized use of your account.

3. PRODUCTS, PRICING AND AVAILABILITY

All prices are listed in Canadian dollars (CAD) unless otherwise stated and are subject to change without notice. We make reasonable efforts to display accurate pricing, product descriptions and availability, but errors may occur. If a product is listed at an incorrect price or is unavailable after you order, we will contact you before completing the order and you may cancel at no charge.

We reserve the right to limit quantities, refuse service, or cancel orders at our discretion, including in cases of suspected fraud, pricing errors, or violations of these Terms.

4. PRESCRIPTION EYEWEAR

When you submit prescription information to us, you confirm that it is accurate, current and provided by you or with the authorization of the patient it belongs to. We rely on the prescription information you provide to prepare your eyewear and are not responsible for errors resulting from inaccurate or outdated information you supply.

Submitting a prescription through the Site does not create an optometrist–patient relationship, and nothing on the Site is a substitute for a comprehensive eye examination or advice from a qualified, licensed eye-care professional. We recommend having your prescription verified by an eye-care professional periodically.

5. PURCHASE OPTIONS AND SUBSCRIPTIONS

Some products may be available as one-time purchases or as recurring subscription (auto-ship) orders. Subscription terms, billing frequency, and cancellation rights are described in our Purchase Options and Cancellation Policy, which forms part of these Terms.

6. PAYMENT

Payments are processed securely through Shopify and its authorized payment providers. By placing an order, you authorize us (or our payment processor) to charge your chosen payment method for the total order amount, including applicable taxes and shipping.

7. SHIPPING

Shipping destinations, costs, and estimated delivery times are described in our Shipping Policy, which forms part of these Terms.

8. RETURNS, EXCHANGES AND CANCELLATIONS

We do not offer refunds; eligible items may be exchanged as described in our Refund/Return Policy. Order cancellation rights are described in our Purchase Options and Cancellation Policy. Both policies form part of these Terms.

9. INTELLECTUAL PROPERTY

All content on the Site—including text, graphics, logos, images, product photography and software—is owned by or licensed to Shoptiko and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any Site content without our prior written permission, except as necessary to view the Site for personal, non-commercial shopping purposes.

Third-party trademarks (including designer eyewear brand names) referenced on the Site belong to their respective owners and are used for identification purposes only.

10. USER SUBMISSIONS

If you submit reviews, comments or other content to the Site, you grant Shoptiko a non-exclusive, royalty-free, worldwide license to use, reproduce and display that content in connection with operating and promoting the Site. You are solely responsible for the content you submit and confirm you have the right to share it.

11. PROHIBITED USES

You agree not to use the Site to: violate any applicable law; infringe our or any third party's intellectual property or privacy rights; transmit malicious code; attempt to gain unauthorized access to the Site or its systems; scrape or harvest data without permission; or interfere with the proper functioning of the Site.

12. THIRD-PARTY LINKS AND SERVICES

The Site may link to or rely on third-party websites and services (such as payment processors or shipping carriers). We are not responsible for the content, accuracy or practices of third-party sites, and your use of them is subject to their own terms and privacy policies.

13. DISCLAIMER OF WARRANTIES

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, except as required by applicable law. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Shoptiko will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products purchased through it. Our total liability for any claim relating to an order will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable Canadian consumer protection law.

15. INDEMNIFICATION

You agree to indemnify and hold Shoptiko harmless from any claims, losses or damages arising from your violation of these Terms or misuse of the Site.

16. GOVERNING LAW

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
